Description of circumstances:
Railway disaster involving the collision of two passenger trains. The collision resulted in:
- significant damage to property;
- death of several passengers;
- significant injuries and damage to the health of several dozen other persons travelling in the trains.
Actions taken:
- Nord Partner, as part of comprehensive cooperation with the Client in handling the loss adjustment process, was responsible for coordinating the loss adjustment process and satisfying the claims of the injured persons. The main challenge in the present case was the need to quickly pay out advances for the victims and relatives who lost their source of income as a result of the event.The size of the event and the multitude of entities involved required proper preparation and conduct of claims for damages in a manner that enables the protection of the good image of our Client, as well as the protection of its property interests. It should be stressed that many cases resulting from the event in question, due to their complexity, were subject to multi-stage verification processes, including court proceedings, in particular concerning disability pension liabilities and their dimension.
Main conclusions:
- the catastrophic extent of the event required a rapid response and cooperation between multiple parties;
- a number of specialists had to be involved, including legal departments and technical departments;
- the diversity of the damage suffered by individual victims and extent thereof required a detailed analysis;
- liquidation activities had to take into account the defence of the good image of the Insured Persons;
- many cases required mediation / settlement actions;
- due to the need to pay long-term benefits, the pensions part of the damage in relation to the amount of benefits had to be verified in court proceedings.
